Accepting These Terms
By downloading, accessing, or using Hearty, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use Hearty.
Apple App Store License
If you download Hearty from Apple’s App Store, Apple’s Standard End User License Agreement applies to your license to use the app. These terms supplement that agreement. If they conflict about the app license, Apple’s agreement controls.
What Hearty Provides
Hearty provides meal guidance, ideas from foods you have, private meal records, optional check-ins, conversations, and other food-information features. Some guidance is generated with artificial intelligence. Features and availability may change as we improve the service.
Not Medical Advice
Hearty is for general informational and educational purposes. It is not a medical device and does not provide medical diagnosis, treatment, or professional dietary advice. Photo recognition, product data, AI responses, and personalized explanations may be incomplete or incorrect. A photo cannot establish that a food is safe for an allergy. Always verify labels, ingredients, allergens, and safety information directly on the product, and consult a qualified professional about medical, medication, or dietary decisions. Individual responses to food vary; Hearty does not guarantee weight loss, appetite changes, or a particular health outcome. Do not use Hearty for emergencies.
Your Account
You are responsible for the accuracy of information you provide, protecting access to your account, and activity under your account. You must notify us promptly if you suspect unauthorized access. You may not impersonate another person or use Hearty if applicable law prohibits you from doing so.
Age Eligibility
You must be at least 18 years old and legally able to agree to these terms to create an account or use Hearty.
Acceptable Use
You may not:
- Use Hearty unlawfully or to harm, threaten, or deceive others.
- Interfere with the service, probe its security, introduce malicious code, or bypass technical limits.
- Scrape, reverse engineer, copy, resell, or commercially exploit Hearty except where applicable law expressly permits it.
- Submit content that infringes rights, violates privacy, or is illegal.
- Misrepresent AI-generated output as professional advice.
Your Content
When you submit content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, analyze, reproduce, and use it as needed to operate, secure, maintain, and improve Hearty and provide the features you request. You confirm that you have the rights needed to submit it.
If you submit a product or package capture through a feature that contributes to shared food and product information, you also grant us a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free license to reproduce, modify, create derived product information from, display, distribute, and otherwise use the capture to improve Hearty’s food and product data and make that content available to other users. This license takes effect when you submit a capture and is a condition of using that feature. This additional shared-content license does not apply to a meal photo, kitchen snapshot, or chat attachment merely because it shows food. Do not submit product captures containing people, personal information, or content you do not have the right to provide.
The shared-product license includes the right to publish or sublicense eligible product captures and resulting product information under public, open-content, or open-database terms.
Subscriptions and Purchases
Some features may require a paid subscription. Prices and billing terms are shown before purchase. Purchases made through Apple are billed and managed by your Apple Account and are subject to Apple’s payment terms. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel a subscription in your Apple Account subscription settings. Except where required by law, payments are non-refundable; Apple handles eligible refund requests for App Store purchases.
Third-Party Services and Product Information
Hearty relies on third-party services and food information from product labels, manufacturers, retailers, public datasets, and other sources. We do not control those sources and do not guarantee that product availability, ingredients, nutrition, allergen details, prices, or other information are complete, current, or error-free.
Ownership
Hearty, including its software, design, branding, and original content, is owned by Senzu Labs LLC and its licensors. These terms do not transfer ownership to you.
Suspension and Termination
You may stop using Hearty or request account deletion at any time. We may suspend or terminate access when reasonably necessary to protect users, comply with law, address a breach of these terms, or protect the service. Provisions that logically continue after termination will survive.
Disclaimers and Limitation of Liability
To the fullest extent permitted by law, Hearty is provided “as is” and “as available” without warranties of any kind. Senzu Labs LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill, arising from your use of Hearty. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
Changes
We may update Hearty and these terms. If changes are material, we will provide notice as required. Continuing to use Hearty after updated terms take effect means you accept them.
Governing Law
Delaware law governs these terms, without regard to conflict-of-law rules. Any dispute must be brought in the state or federal courts located in Delaware, unless applicable consumer law requires otherwise.
